Zimbabwe’s Supreme Court has thrown out an attempt by former National Social Security Authority chief executive Robin Vela and his company, Firstmile Apartments (Livingstone Avenue) Private Limited, to revive an appeal in a debt dispute with Al Shams Global Limited. The case, reported by New Zimbabwe and distributed by AllAfrica, centers on a provisional sentence claim tied to an acknowledgement of debt in favor of Al Shams, a property development company registered in the British Virgin Islands and owned by businessman Jayesh Shah.

According to the report, the Commercial Court had earlier dismissed a constitutional challenge by Firstmile Apartments and awarded costs to Al Shams, after which the applicants sought to appeal. That appeal was later treated as abandoned because required court service steps were not completed on time. The applicants then asked the Supreme Court for condonation and reinstatement, saying the lapse was due to their former lawyer’s oversight.

Justice Jacob Mafusire did not reach the merits of that request. Instead, he ruled on July 17, 2026, that the application had been filed without proper authority because the lawyers who lodged it no longer represented the company. The court said a company must act through duly authorized representatives and found that a later board resolution could not fix the defect. The judgment also noted concerns over a supporting affidavit said to bear the signature of Gaudencia Rufaro Vela, with the court recording that its authenticity was not accepted. The ruling matters because it ends, at least for now, the effort to reopen the appeal and underscores Zimbabwean procedure on corporate legal representation.
