Namibia: Magistrate Warns Against Use of Public Interest to Oppose Bail

Namibian magistrate Bornface Konga has criticized prosecutors for opposing bail with broad appeals to “public interest” and the “administration of justice” without presenting evidence to support those claims, according to The Namibian, as republished by AllAfrica. He made the remarks on Friday while ruling on bail applications involving five accused people, including former Onandjokwe nurse Festus Amwaalwa, intern doctor Kelsey Kudumo, medical doctor Gomes Valera, nurse Michael Kaviyu and Sanlam financial adviser Getrude Iipinge.

The case centres on allegations tied to a fraudulent N$1.2 million claim involving Klaudia Martin and Sanlam, along with several additional fraud allegations involving other sums and other named individuals. Prosecutors argued that the accused should remain in custody because their release could undermine public confidence and affect the investigation. Konga rejected that reasoning, saying the court should not deny constitutional rights simply because the applicants are medical professionals or because of their social standing.

Konga also examined the state’s claim that the investigation was still ongoing and could take months. He said the investigating officer had not explained clearly how bail would interfere with the case, especially since some devices and documents had already been sent for analysis and other evidence was already held by the state and Sanlam. He concluded that concerns about flight risk or witness interference could be managed through bail conditions, and each of the five accused was granted bail of N$25,000.
