Kenya: Ngong Road-Naivasha Flyover Project Under Scrutiny As Kura Faces Constitutional Petition

Capital FM, in a report distributed by AllAfrica, says a constitutional petition has been filed at the High Court in Nairobi seeking to force the Kenya Urban Roads Authority to release records on the Ngong Road-Naivasha Road Flyover project. The petition was brought by governance advocate and public interest litigant Francis Awino against KURA and its Director General, Silas Kinoti.

According to the report, Awino says he submitted an information request on June 19, 2026, under Article 35 of Kenya’s Constitution and the Access to Information Act, but alleges KURA did not provide the records or give a legal reason for withholding them within the required period. He argues that because the project uses public funds, members of the public are entitled to review key documents.

The records sought reportedly include budget approvals, procurement and tender files, bid evaluation material, contracts, payment records for contractors and consultants, implementation schedules, variation orders, inspection documents, audit reports and expenditure statements. The petition cites several constitutional provisions, including those on national values, access to information, fair administrative action, leadership and integrity, public finance, and public service standards.

Awino is asking the court to declare the alleged non-disclosure unconstitutional, order KURA to release the information within seven days, involve the Commission on Administrative Justice in monitoring compliance, and award damages for alleged violation of his rights. The case matters beyond this specific flyover because it tests how Kenya’s access-to-information framework applies to publicly funded infrastructure projects and the transparency obligations of state agencies.
