Court Overturns NUP’s Luyombya Victory, Declares NRM’s Kitosi Winner in Nakawa

What the report says
Nakawa Chief Magistrate’s Court has overturned the election of National Unity Platform councillor Godfrey Luyombya in Nakawa Division II and ordered the Electoral Commission to recognize National Resistance Movement candidate Kitosi Emmanuel as the valid winner. According to Nile Post, the ruling was delivered on October 29, 2026 by Chief Magistrate Adoko Joe Fay in a petition challenging the January 22, 2026 election for directly elected councillor in Nakawa Division II, Kampala District.
The court found that Kitosi had sufficiently shown electoral non-compliance that materially affected the result and had also presented numerical evidence supporting his claim to the seat. On that basis, the magistrate nullified the Electoral Commission’s earlier declaration of Luyombya as winner and directed that Luyombya vacate office immediately. The court also ordered the commission to gazette Kitosi as councillor with immediate effect.
The judgment further awarded Kitosi the costs of the petition against Luyombya and the Electoral Commission. Nile Post reported that the decision was issued electronically through the court’s case management system, with the parties notified through their accounts. The ruling shifts the outcome of a contested local election and underscores how election petitions can alter who holds office when a court finds the original process was not properly conducted.
