CNN reports that Bryan Kohberger, who pleaded guilty to killing four University of Idaho students in Moscow, Idaho, is seeking to withdraw that plea about a year after making it in court. Kohberger admitted guilt in a July hearing before Judge Steven Hippler and later received life in prison without parole, avoiding Idaho’s death penalty. The victims were Ethan Chapin, Kaylee Goncalves, Xana Kernodle and Madison Mogen, who were killed in their home in the early hours of November 13, 2022.

According to CNN, Kohberger said in a court filing Monday that his plea was not knowing or voluntary and alleged ineffective assistance by his attorneys. He claimed the plea was driven by unkept promises, threats, and misleading descriptions of prison life, and that lawyers failed to discuss evidence he believes could support his innocence. CNN also cited a statement provided to The New York Times in which Kohberger asserted actual innocence and said the plea should be withdrawn.

Legal experts interviewed by CNN said Kohberger faces a difficult path. University of Idaho law professor Samuel Newton said Kohberger’s appeal waiver is significant, but post-conviction proceedings can address claims such as coercion or ineffective counsel. CNN legal analyst Joey Jackson noted that Idaho’s standard becomes much tougher after sentencing: a plea may be withdrawn only to correct a “manifest injustice,” rather than for a pre-sentencing “fair and just reason.”

The experts said Kohberger would need credible evidence that misrepresentation or deficient legal work affected his decision and that he likely would have gone to trial otherwise. They also said his sworn courtroom statements, including that he was pleading guilty because he was guilty and was acting voluntarily, will weigh heavily against him.
