US judge blocks Pentagon blacklisting of AI firm Anthropic

What the report says
A US federal judge has blocked the Pentagon’s decision to blacklist Anthropic, the maker of the Claude AI system, in a ruling reported by Al Jazeera on 28 August 2026. District Judge Rita Lin said the Defense Department acted illegally when it designated the company a national security supply-chain risk, a step that had cut Anthropic off from military contracting opportunities.
According to the report, the dispute centers on Anthropic’s refusal to let the US military use its AI models for domestic surveillance or autonomous weapons. The company has argued that current AI systems are not dependable enough for weapons use and has objected to surveillance applications. In its lawsuit, Anthropic said the Pentagon retaliated against its public criticism of military AI policy and violated its free-speech and due-process rights.
The judge’s written order said national security cannot be used as a justification to punish government critics. Al Jazeera reported that the decision follows earlier hearings in which the court expressed concern about the government’s reasoning. The Pentagon is expected to challenge the ruling.
The case matters because it highlights a wider struggle over how advanced AI should be used by governments and militaries, and how much leverage the US defense establishment has over private AI companies. Al Jazeera noted that the designation was the first publicly known use of an obscure procurement statute in this way.
