Erin Patterson, the Australian woman convicted over a fatal mushroom lunch in rural Victoria, is back before the courts as she seeks to overturn her murder convictions, according to BBC World News. Patterson was jailed for life last year after serving beef Wellington containing death cap mushrooms to relatives at her home in Leongatha in 2023, killing her in-laws Don and Gail Patterson and Gail’s sister Heather Wilkinson, and seriously harming Heather’s husband, Ian Wilkinson.

The BBC reports that Patterson is challenging the verdict on several grounds. Her lawyers argue that some evidence shown to jurors, including mobile phone location data and social media messages about family members, should have been excluded as unfairly prejudicial. They also say other material, such as photos linked to her mushroom foraging, should have been admitted because it supported her claim that the deaths were a tragic accident. In addition, they criticize aspects of the prosecution case, including its handling of motive and the cross-examination of Patterson.

A major part of the appeal concerns the jury’s accommodation during deliberations. The defence says a hotel arrangement shared with members of the prosecution, a police witness and journalists created a serious irregularity, even though no direct contact was found. Patterson is appearing by video link from prison in Melbourne, rather than in person.

At the same time, prosecutors are appealing her sentence, arguing that parole eligibility after 33 years is too lenient. The Court of Appeal’s decision could take months and may result in a retrial, acquittal, or a tougher sentence if the prosecution succeeds.
