The Atlanta Journal-Constitution reported that Tenisha Warner, widow of actor Malcolm-Jamal Warner, has sued his mother, Pamela Warner, in DeKalb County Superior Court over money she says is owed under a prenuptial agreement. The suit, filed Monday on the first anniversary of Warner’s death, seeks at least $1.2 million from the Warner Family Trust, which Pamela Warner now oversees as successor trustee. Warner, known for playing Theo Huxtable on “The Cosby Show,” drowned in Costa Rica last July while on vacation at age 54.

According to the AJC, Tenisha Warner argues that her late husband did not fulfill obligations in a May 2022 premarital contract and that this makes her a creditor of his estate. Her complaint says the estate is not currently represented and may not have enough assets to satisfy the alleged debt. The lawsuit also asks the court to prevent trust property from being distributed while the dispute is pending.

The article says the agreement required Malcolm-Jamal Warner to obtain life insurance policies, make monthly and annual payments to Tenisha Warner, contribute to a retirement account for her and maintain college funds for their children. Tenisha Warner alleges those promises were not met and is seeking $1,276,042 plus interest and attorney fees. She also filed a creditor’s claim in DeKalb County Probate Court for the same amount.

The AJC reported that attempts to reach Pamela Warner were unsuccessful and Tenisha Warner’s lawyers did not respond Monday. In a Tuesday statement, Tenisha Warner said she had tried to resolve estate issues privately and took legal action to protect herself and the couple’s 9-year-old daughter.
