Malawi: Health Scare for Jailed Activist Namiwa As High Court Still to Rule On Bail

The Centre for Democracy and Economic Development Initiatives, which Namiwa leads, said he was there for a check-up before he was returned to prison. Supporters have been watching his condition closely as he remains detained pending a High Court decision on bail.
Namiwa was arrested on July 30, 2026, and faces charges including treason and publishing news likely to cause public alarm. His lawyer, Gift Mwenye, has asked the court to grant bail, while the state has reportedly said it does not oppose release in principle. However, the two sides have disagreed over proposed conditions, including a K2 million bail bond, sureties, surrender of travel documents and regular reporting to police.
The case matters because treason charges in Malawi are handled by the High Court, and Namiwa’s earlier attempt to seek bail before a magistrate’s court failed on jurisdictional grounds. Judge Mzonde Mvula said more time was needed to review the submissions before ruling. The outcome will determine whether Namiwa remains in custody while the case proceeds or is released under conditions set by the court.
