Lindsay Clancy appears in court as her lawyer pushes for murder case to be dismissed

Lindsay Clancy, the Massachusetts woman accused of killing her three young children in 2023, appeared in court for the first time since her trial ended without a verdict earlier this month. According to the BBC, her defence team asked the judge to dismiss the murder case, while prosecutors argued that the state had already presented enough evidence to prove guilt.

Clancy, 36, does not dispute that her children died, but her lawyers say she was experiencing severe postpartum psychosis at the time. Prosecutors maintain the killings were intentional. At Tuesday’s hearing, defence lawyer Kevin Reddington also argued that the evidence was insufficient to support a murder conviction under a Massachusetts rule that can lead to a not-guilty finding if the prosecution has not made its case.

The court did not decide whether Clancy will face a retrial. Judge William Sullivan said the dismissal motion and other issues will be discussed at a hearing on 2 November, and he urged both sides to be ready to address possible future trial dates. Outside court, District Attorney Timothy Cruz said prosecutors had not yet decided whether to retry the case, but were continuing to review it.

The case has drawn wide attention because it combines a highly publicised family tragedy with difficult questions about mental health and criminal responsibility. A jury deadlocked after about a week of deliberations, leading to a mistrial on 4 September.
