Kenya: Sonko Questions Supreme Court Over Ag Advisory Opinion On Impeachment, Hints At Fresh Legal Challenge

AllAfrica, carrying a Capital FM report from Nairobi dated July 24, 2026, says former Nairobi Governor Mike Sonko has challenged the Supreme Court’s decision to ask the Attorney General for an advisory view on whether impeached state officers may run for office while appeals are still active. Sonko argues the court already settled the question in 2022, when it upheld his own impeachment.

According to the report, Sonko also revived objections he raised during that case, including his claim that then Chief Justice Martha Koome’s public comments before judgment created an appearance of bias. He said his request for her to step aside was rejected. He further questioned the speed of the proceedings, saying his lawyers were required to file submissions on a tight timeline while they were also engaged in a High Court matter in Mombasa.

Sonko described his impeachment as politically motivated and referred to an East African Court of Justice ruling that, in his account, found procedural problems and fair-trial concerns in the process. Capital FM reported that he now plans to seek a review of the Supreme Court decision, citing what he calls new and compelling evidence, and intends to consult legal experts, constitutional scholars and the public.
