Kenya: LSK Probes Kaguchia, Kaluma Over Alleged Inciting Remarks

The Law Society of Kenya has ordered a review of public remarks attributed to two lawyer-politicians, Mukurwe-ini MP John Kaguchia and Homa Bay Town MP Peter Kaluma, to determine whether their statements amount to professional misconduct. According to the report carried by Capital FM and republished by AllAfrica, the Society said its ethics and disciplinary committee will examine publicly available records within 14 days and decide whether there is a prima facie case for referral to the Advocates Disciplinary Tribunal.
The move comes as both lawmakers face separate scrutiny by state agencies over allegedly inflammatory political comments. Kaguchia was arrested in Nairobi after remarks made at political events in Nyeri County, while Kaluma is under investigation over statements linked to a rally in Homa Bay that was later followed by violence. Both MPs have disputed the accounts attributed to them. The report says Kaguchia has argued his comments were misrepresented, while Kaluma has challenged the transcription and translation of his alleged remarks.
LSK president Charles Kanjama said political office does not suspend a lawyer’s professional obligations. The Society stressed that its internal review is separate from any criminal or security investigations, and that advocates remain bound by ethical standards even when active in politics. The matter matters because it reflects rising concern in Kenya over incendiary election-related rhetoric ahead of the 2027 general election, and because any finding of misconduct could eventually lead to formal disciplinary action under the Advocates Act.
