The Kenyan High Court has dismissed Nakuru Town East MP David Gikaria’s bid to overturn sanctions imposed by the Independent Electoral and Boundaries Commission (IEBC), leaving in place a Sh2.5 million fine and an order that he issue a public apology and retraction. The decision was reported by Capital FM and distributed by AllAfrica, with the ruling delivered by Justice William Musyoka in Nairobi on Thursday.

According to the report, the dispute arose from remarks Gikaria made while campaigning ahead of the July 16 Ol Kalou parliamentary by-election. The IEBC’s Electoral Code of Conduct Enforcement Committee found that his comments on cash handouts and the collection of national identity card details could amount to prohibited conduct under election rules. Gikaria had argued that the ID details were being collected for accountability purposes and were not intended to influence voters.

The High Court also ended temporary orders that had paused implementation of the IEBC’s July 14 decision. In addition to the fine and apology, the committee had issued a formal warning and referred the matter to the Office of the Director of Public Prosecutions for possible investigation. The ruling supports the IEBC’s authority to enforce electoral conduct rules and comes against a broader backdrop of efforts to curb voter inducement and protect election integrity in Kenya.
