What the report says

Former Nairobi Provincial Commissioner Nathan Davis Chelogoi has been sentenced to three years in prison after a Kenyan court found him guilty of unlawfully taking possession of property belonging to businessman Ashok Shah, according to Capital FM as republished by AllAfrica. The ruling was delivered in Nairobi by Trial Magistrate Dolphina Alego, who said the prosecution had proved its case beyond reasonable doubt.

The dispute centers on a parcel of land in Lower Kabete, Nairobi County. During mitigation, Chelogoi’s lawyer asked the court to consider a non-custodial sentence, pointing to the former official’s age, reported health concerns and his claim that the land had been allocated by the government during the administration of former President Daniel arap Moi. The defense also said there was a separate case over the property before the Environment and Land Court.

The court did not accept those arguments and imposed the custodial sentence. The defense has indicated it will seek typed proceedings to prepare an appeal against the conviction. The case is notable because it involves a former senior administrator and a long-running land dispute, an issue that has often drawn public attention in Kenya due to contested ownership, allocation history and overlapping court proceedings.
