Kenya: DPP Files 17 Fresh Charges Against DCI, NIS Officers Over 2022 Kidnapping of Two Indians and Kenyan Driver

Kenya’s Director of Public Prosecutions has filed 17 new charges against 15 officers from the Directorate of Criminal Investigations and the National Intelligence Service in connection with the 2022 alleged kidnapping of two Indian nationals and their Kenyan driver, according to Capital FM as distributed by AllAfrica. The case involves an incident said to have taken place in Nairobi County on July 22, 2022, when the officers and other unidentified people allegedly intercepted a vehicle carrying Mohammed Zaid Sami Kidwai, Zulfiqar Ahmed Khan and driver Nicodemus Mwania Mwange.

The accused include Peter Gachiku, James Tanki, Joseph Mbugua, David Kipsoi, Joseph Mbaya, John Kamau, Hillary Kipchumba, Stephen Matunda, Simon Gikonyo, Paul Muriithi, Bonface Mtulia, Elikana Mugendi, Fredrick Kamau, John Mavhari and Michael Bett. The charges reported include kidnapping with intent to murder, conspiracy to commit a felony, forgery, and subjecting a person to cruel, inhuman or degrading treatment. Some counts are brought under the Penal Code and others under the National Intelligence Service Act.

The DPP said the new filing follows the High Court’s termination of earlier murder proceedings, which cleared the way for a fresh case based on available evidence. The suspects are due to appear before the Kahawa Law Courts on September 7, 2026, for plea-taking before Senior Principal Magistrate Njeri Thuku. The development is significant because it revives a sensitive case involving alleged abuse of official power and the treatment of foreign nationals in Kenya.
