Scott Perry, a Pennsylvania Republican, is promoting the No Kill Switches in Cars Act, a short bill aimed at repealing a provision from the Infrastructure Investment and Jobs Act signed under former President Joe Biden. The provision directs federal regulators to require new vehicles to include passive technology intended to detect driver impairment and prevent or limit vehicle operation when impairment is identified.

Perry told Fox News Digital that he views the requirement as a “kill switch” mandate and argued it could raise vehicle costs, intrude on privacy and create safety risks if a system mistakenly disables a car. He said he supports efforts to reduce impaired driving, including enforcement of existing laws, but contends the federal requirement would burden all drivers because of the actions of some. He also framed the issue as part of broader concerns about surveillance technologies and Fourth Amendment protections.

Fox reported that the National Highway Traffic Safety Administration has not yet finalized rules implementing the provision and missed a 2024 deadline. An agency spokesperson told Fox that NHTSA is reviewing public input on research and possible rulemaking. Fox also cited a 2024 report to Congress indicating many reviewed technologies remain in early development or were not designed for use inside vehicles.

The debate matters because the rulemaking could affect future vehicle design, consumer costs, privacy expectations and anti-drunk-driving policy.
