DPP Sanctions Charges Over Fraudulent Dealings in Late Garuga's Estate Assets

The Director of Public Prosecutions has sanctioned criminal charges against three people in connection with alleged fraudulent dealings involving companies and property tied to the estate of the late businessman Dr James Musinguzi Garuga, according to Nile Post. The accused are Agaba Maguru, Henry Hapa Nganwa and Byaruhanga Charles, following police investigations and review by the DPP.
Nile Post reports that the case centers on an alleged transfer of about 849 hectares of land in Bulemezi Ngoma, Nakaseke District, land said to be registered to Incafex Limited, a company linked to Garuga’s business interests. Prosecutors allege the transfer was done without proper corporate authority and in breach of a Supreme Court injunction. They also allege manipulation of company records through filings and special resolutions, including claims that Maguru was entered as a director in records that still listed Garuga and other deceased persons.
The charges include fraudulent transfer of title, false statements by company officials and conspiracy to defraud. The matter follows an earlier company-register dispute in which the Uganda Registration Services Bureau removed filings that had appointed Maguru as a director of Garuga-related companies. That dispute arose after Garuga’s death in August 2025 and involved questions over control of Garuga Properties, Kinkizi Development Company and Incafex.
Nile Post also says investigators have been told to keep probing other suspected offenses, including possible theft of cattle, embezzlement, disputed land transactions and alleged misuse of company funds. The broader case adds a criminal layer to an already contested estate and corporate succession dispute.
