DPP opposes Lukwago’s bail application, cites flight risk

The Observer reports that Uganda’s Director of Public Prosecutions has asked the High Court Criminal Division to reject bail for People’s Front for Freedom president Erias Lukwago. In an affidavit, chief state attorney Joseph Kyomuhendo argues that Lukwago, 56, has not shown exceptional circumstances justifying release while he awaits trial on a charge of misprision of treason.

According to the report, Lukwago was committed to the High Court last week after Makindye Chief Magistrate’s Court found that police investigations were complete. The indictment, signed by assistant DPP Thomas Jatiko, alleges that between 2021 and November 2024 Lukwago failed to report information about an alleged plan to overthrow the government. Prosecutors say he knew that opposition figures, including Dr Kizza Besigye, Hajji Obeid Lutale, Joel Wakhaima and Frank Kiherere Atukunda, allegedly intended to commit treason, but did not alert authorities or take steps to prevent the alleged offences.

The Observer says Lukwago’s bail bid cites the presumption of innocence and concerns that prison facilities cannot properly handle his medical needs. The state disputes this, saying Uganda Prisons Service medical staff can provide care, and also denies claims of assault, forced drills or detention conditions worsening his health. Prosecutors further argue that Lukwago’s political and professional standing could enable witness interference, that his sureties are insufficient, and that the seriousness of a charge carrying a possible life sentence heightens the risk of absconding.

Justice David Matovu directed both sides to file written submissions rather than make oral arguments. A ruling is expected on July 30 through the Electronic Court Case Management Information System. Lukwago’s lawyer, Medard Lubega Sseggona, said after court that the defence remains worried about his client’s health and had sought referral to Mulago National Referral Hospital.
