Court Rejects Nyanzi Bid for Original Kawempe South Election Records

The High Court in Kampala has rejected Fred Nyanzi Ssentamu’s request for original electoral records from 73 polling stations in Kawempe South, in a ruling connected to his election petition against Madina Ntale Nsereko. The decision was issued by Justice Faridah Shamilah Bukirwa Ntambi on September 28, 2026, according to Nile Post.

Nyanzi had asked the court to compel the Electoral Commission to produce several materials, including original Declaration of Results Forms, official report books, ballot accountability forms, scanner printout reports and deployment books. He also sought similar documents from Nsereko. His petition alleges irregular handling of results in favor of the respondent, but the judge said he had not provided enough evidence to justify inspection of the originals.

The court found that Nyanzi had not shown any concrete mismatch between the certified forms held by the Electoral Commission and the versions he said were received by his agents. It also said he had not pointed to specific discrepancies in the other records he wanted examined. On that basis, the judge ruled that the request amounted to a search for evidence rather than a targeted discovery application.

The ruling does not resolve the underlying election petition itself. In general, election petitions in Uganda can involve disputes over polling station records, result forms and vote tabulation, and courts often assess whether an applicant has laid a factual basis before ordering broader disclosure.
