Nile Post reported that the High Court in Kampala has given the Ugandan government seven days to establish the whereabouts of former Butambala County MP Muhammad Muwanga Kivumbi before it decides whether to issue a writ of habeas corpus. Justice Collins Acellam directed the Chief of Defence Forces, the Inspector General of Police and the Attorney General to file an affidavit detailing the results of inquiries into where Kivumbi is.

The application was filed by Kivumbi’s lawyers, who allege he was taken on July 10 at a police checkpoint in Mpigi by unidentified military operatives after he had been released on bail by the High Court. In a supporting affidavit, his brother Hajj Musa Lutaaya said they were travelling together when their vehicle was stopped near Mpigi Police Station, and alleged that officers helped force Kivumbi into another vehicle.

Police denied holding the former MP. Nile Post reported that Assistant Commissioner of Police Godwin Tumugumye told court in an affidavit that there was no police record of Kivumbi’s arrest or detention, and that he was not in any police facility. The court was also told of allegations that Kivumbi was later taken to Bombo Military Hospital in critical condition, but those claims remain attributed to the applicant’s side.

Justice Acellam said habeas corpus is meant to protect personal liberty by requiring a detaining authority to produce a person in court, but ruled that such an order cannot be effective until the court knows who, if anyone, is holding Kivumbi. The matter is set for mention and hearing on July 29, 2026.
