BBC News reports that Scott Winters, a 55-year-old pastor from Florida, has filed a lawsuit against OpenAI and its founder, Sam Altman, alleging that medical guidance from ChatGPT contributed to a near-fatal emergency. The case, filed in San Francisco County Superior Court on 21 July, claims the chatbot repeatedly gave him incorrect reassurance about symptoms before he suffered a major pulmonary embolism involving blood clots in both lungs.

According to the BBC, Winters’ lawyers say he had become a regular ChatGPT user and relied on it while experiencing dizziness, unstable blood pressure and declining mobility. The lawsuit alleges the chatbot advised him to remain in a recliner and discouraged medical care, despite family and friends urging him to go to hospital. Court documents cited by the BBC say doctors linked the embolism to immobility.

The complaint also alleges ChatGPT mixed health advice with religious language, drawing on Winters’ Christian faith in ways his lawyers say deepened his dependence on the tool. They argue the chatbot’s authoritative and affirming tone undermined his judgment and left him isolated from people encouraging medical treatment. The lawsuit seeks damages and asks the court to require OpenAI to add safeguards intended to reduce similar risks.

OpenAI’s Drew Pusateri told CBS News, the BBC’s US partner, that ChatGPT is not a doctor and should not replace medical care, diagnosis or treatment. The BBC also noted that OpenAI’s terms warn users not to rely on ChatGPT as a sole source of truth for major decisions, including medical ones. The case adds to wider scrutiny of how AI chatbots handle health-related queries and vulnerable users.
