Artist sues AI meme generator for selling deeply personal comic as ad template - Ars Technica

Ars Technica reports that Filipino digital artist Elmer Saflor, known online as “Superelmer,” has sued Memes Apps, the operator of Memes.ai and Memes AI Studio, over alleged unauthorized commercial use of his “Running Away Balloon” comic. The two-panel comic became a widely shared meme in 2017. Saflor told Ars he welcomes ordinary online remixing, but objects to an AI-powered meme generator allegedly offering his copyrighted work as a paid ad template.

According to Ars, the lawsuit, filed earlier in July 2026, claims Memes Apps sold subscriptions to a tool that could generate copies of the comic without permission. Saflor said he did not contact the company before suing and had not personally seen ads made from his meme, but brought the case to seek discovery and determine how the work may have been used. Ars said it could not immediately reach Memes Apps for comment or verify whether subscribers used the template in advertisements.

Internet law scholar Eric Goldman told Ars that Saflor’s claim may draw support from a 2024 “SuccessKid” meme ruling that treated campaign-ad use differently from noncommercial meme sharing. But Goldman said targeting the meme platform rather than individual advertisers could raise broader issues for courts, because many meme generators depend on copied templates. He also noted that proving damages may be difficult if use of Saflor’s specific image cannot be shown.

The case matters because it sits at the intersection of meme culture, advertising, and AI copyright disputes. Ars reports Saflor wants an order stopping use of the comic and an accounting of any ads or profits tied to it.
